Caxstone Phelix Kigata joined Wamae & Allen Advocates as a pupil on 6th January 2014. He was admitted to the Bar on 3rd December 2014 becoming an Advocate of the High Court of Kenya wherein he was retained by the firm for his astuteness and perspicacity in advising Clients and providing practical solutions to the needs of the Client. Caxstone is now a Senior Advocate at the firm and is committed to developing Jurisprudence and ensure that the firm meets its goals and targets. He has a keen interest in Labour Relations and Employment Law, Constitutional Law, Banking Law; Insurance Law, Probate and Administration and Company Law. His colleagues describe him as resolute, dependable and a person of integrity.

Experience and success

  • He and Allen successfully lodged an appeal against the judgment of a Malindi Law Court that had divested the Magistrates court with the hearing and determining environment, land, employment and labour related matters. The impugned judgment had led to back-log of cases at the Environment and Land Court and Employment and Labour Relations Court.
  • He and Allen further successfully lodged an appeal to the Court of Appeal against a decision of the Employment and Labour Relations Court that had awarded former employees of Heritage Insurance Company Limited damages for unlawfully redundancy amounting to Kshs.93 Million. The Court of Appeal set aside the entire judgment of the Employment and Labour Relations and established the principle that once the process of declaring employees redundant is followed, the employees are not to be awarded any damages.
  • His negotiations skills were evident when he successfully settled a matter that had been screened for mediation in the matter between Britam Insurance Company and Victoria Insurance Brokers Limited.
  • He has further scored big in matters before the Employment and Labour Relations Court where former employees had sued their employer for unfair termination. The Clients he represented are Nairobi Hospital, Nairobi Water and Sewerage Company Limited, Consolidated Bank, Family Bank, Barclays Bank, Gulf African Bank, ICEA Lion Insurance Limited and Saham Assurance Company Limited
